President Biden Signs Social Security Fairness Act; Repeals WEP and GPO

On January 5, 2025, President Biden signed the Social Security Fairness Act, which repeals two federal laws – the Windfall Elimination Provision (WEP) and the Government Pension Offset (GPO). The provisions had been in place for nearly 40 years and reduced Social Security payments to nearly three million retirees, including some PSRS monthly benefit recipients.
With the repeal, Social Security benefit reductions caused by WEP and GPO will end. As a result, PSRS members who receive Social Security benefits that are reduced due to WEP or GPO will receive increased Social Security benefits retroactive back to January 2024 payments.
The implementation of these changes will be handled by the Social Security Administration. Specific questions regarding the bill’s implementation, timing and impact on individual benefits should be directed to the Social Security Administration.
